    Donegal man faces trial over alleged assault of granddaughter

    A Donegal resident is set to stand trial following accusations of assaulting his granddaughter, who is a minor.

    During a session at Letterkenny District Court, a book of evidence was presented to the man’s solicitor.

    Garda Sergeant Jim Collins informed the court that the book of evidence was officially served to Mr. Rory O’Brien.

    To protect the identity of the alleged victim, the defendant’s name is being withheld.

    The charges relate to an incident that allegedly occurred in May 2024. He is accused of assaulting the victim and causing her harm, a violation of Section 3 of the Non-Fatal Offences Against the Person Act, 1997.

    Sergeant Collins conveyed to the court that the Director of Public Prosecutions (DPP) has approved the accused’s case being transferred to Letterkenny Circuit Court.

    Judge Eiteáin Cunningham formally ordered the man’s return for trial. She also issued a Section 56 order regarding video recordings of interviews and provided the alibi warning.

    Legal aid was granted to Mr. O’Brien, and he was assigned one legal representative.

    Mr. O’Brien commented that the case is “a matter of significant dispute” and stated, “His family are in complete agreement about this allegation.”
