A Co Donegal businessman has been extradited from England to face a charge of assaulting a man in a Letterkenny hotel almost six years ago.
Property developer Anthony Sharkey appeared at Letterkenny District Court before Judge Brendan O’Reilly.
The 52-year-old, with addresses in Falcarragh and the Isle of Man, is charged with assault causing harm to a man at the Mount Errigal Hotel on December 31st, 2019.
The accused was detained by British police after attempting to board a flight from Bristol Airport to Spain on July 11th.
Airport police discovered an arrest warrant for Sharkey related to the incident.
The court heard that Sharkey, with an address at Highcroft, Douglas in the Isle of Man, did not contest the EU/UK Trade and Cooperation Agreement (TCA) warrant.
He appeared at Letterkenny District Court accompanied by his brother.
Gardaí objected to bail for the married father-of-three, citing concerns he would flee the jurisdiction if released.
Garda Michael Rafferty, of Letterkenny Garda Station, provided details of the alleged incident in which a man was attacked at the hotel six years prior.
The court was informed that the man sustained facial lacerations and required stitches at Letterkenny University Hospital for two separate wounds.
Garda Rafferty stated that Gardaí had made extensive efforts to contact Sharkey after he left the scene in a taxi on the night of the incident.
He added that the investigation included CCTV footage showing the accused at the scene.
Barrister Gareth McGrory, instructed by solicitor Frank Dorrian, representing Sharkey, stated that his client was travelling on a family holiday to Madrid when apprehended by British police and cooperated fully with extradition proceedings.
He said his client also had an address in Ballina, Falcarragh and was prepared to surrender his passport, sign on at a local Garda station, and pledge not to leave the jurisdiction.
Mr. McGrory added that his client confirmed he could manage his business remotely from Donegal.
However, Garda Rafferty maintained An Garda Síochána’s objection to bail.
Judge Brendan O’Reilly, after considering the bail application, granted bail with several conditions.
He required a surety of €10,000, a cash lodgement of €10,000, that Sharkey reside at his address in Ballina, Falcarragh, sign on twice weekly at Letterkenny Garda Station, provide Gardaí with a mobile phone number, and not leave the jurisdiction without Gardaí agreement.
Judge O’Reilly adjourned the case until September 17th.
